myShift Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and AMS IT Solutions ("AMS," "we," "our," or "us") governing your use of the myShift mobile application (the "App") and related services. By creating an account, signing in, or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.

You may use myShift only if you are (a) at least 18 years old (or the age of majority where you live), and (b) employed by a business that has licensed myShift from AMS. Your store owner or an authorized manager provisions your account and links it to your store. You are responsible for keeping your credentials confidential and for any activity that occurs under your account.

You agree not to:

• Reverse engineer, decompile, or attempt to derive source code from the App.
• Share your account, transfer your account to anyone else, or let another person clock in or out on your behalf.
• Attempt to bypass, spoof, or otherwise defeat shift-integrity controls, including location verification, heartbeat requirements, the single-device rule, or scan requirements.
• Use the App to harass, defraud, or harm your employer, coworkers, or customers.
• Interfere with the App's operation, probe for vulnerabilities without authorization, or scrape data at scale.

Suspected violations may result in immediate suspension of your account and notification of your store owner.

Your store owner owns the store's operating data — shift records, cash counts, sales, inventory, and everything else the App captures about the business. You own the personal profile fields you fill in (name, contact info, avatar).

AMS retains all rights in the App itself, including its software, designs, trademarks, and documentation. Nothing in these Terms transfers ownership of the App to you.

Your access to myShift is tied to your employment. When your employment at a myShift-using store ends, your access to that store's data ends. If you are no longer employed at any myShift-using store, your account may be disabled.

You may delete your account at any time from Profile → Delete Account in the App, or by submitting the web deletion form. Deletion is governed by our Privacy Policy.

AMS may suspend or terminate your access if you violate these Terms or if we're required to by law.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AMS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR THAT ALL CLOCK-IN OR CLOCK-OUT ATTEMPTS WILL SUCCEED IN EVERY CONDITION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMS AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST WAGES, OR LOST DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Payroll disputes are between you and your employer. AMS records shift activity and provides the tools your employer uses to run payroll, but AMS is not your employer and is not responsible for wages or benefits.

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. You and AMS agree to the exclusive jurisdiction of the state and federal courts located in Missouri for any dispute arising out of these Terms or the App.

We may update these Terms from time to time. If we make a material change, we'll notify you inside the App before the change takes effect. Continued use of the App after the effective date of the change means you accept the updated Terms.
